Hereinafter referred to as “the Service Provider”.
2. Scope of application
These General Terms and Conditions (GTC) apply to all services offered by dental3ddesign.
Services are strictly reserved for professional customers working in the dental field.
All orders imply full and unreserved acceptance of these terms and conditions.
3. Nature of services
dental3ddesign exclusively provides digital design services for dental files (in particular STL files or equivalent).
Delivered files :
are numerical representations only,
are provided for information only,
have no medical, clinical or therapeutic purpose.
They do not constitute an opinion, analysis or validation.
4. Total lack of medical advice and competence
dental3ddesign expressly declares that :
no healthcare professionals are employed by or associated with the company,
no medical, paramedical or clinical skills are claimed,
no service constitutes an act of care, diagnosis or treatment.
Files supplied :
does not constitute advice,
cannot be interpreted as a clinical recommendation or validation,
are provided for information purposes only.
Any interpretation or use is the sole responsibility of the Customer.
Dental3DDesign exclusively provides digital services.
No medical devices are physically manufactured, marketed or delivered by Dental3DDesign.
Manufacturing, regulatory compliance and clinical use are the sole responsibility of the laboratory and the professional responsible.
5. Exclusion of all prosthesis manufacture
dental3ddesign is not a denture manufacturer.
The company is not involved at any time in :
manufacturing,
transformation,
marketing,
certification,
regulatory compliance
of medical devices and dental prostheses.
The files supplied do not constitute medical devices within the meaning of French or European regulations.
6. Customer’s liability
The Customer acknowledges and accepts that :
the files provided are rough, indicative and not clinically validated,
it is the user’s responsibility to check, modify, adapt or refuse them before any use,
any manufacture or end use is the sole responsibility of the healthcare professional.
The Customer remains solely responsible for :
clinical and functional results,
regulatory compliance of the final product,
the safety of the manufactured device,
the relationship with the end patient.
7. Limitation of liability
dental3ddesign shall not be held liable in particular in the event of :
functional or aesthetic defect,
non-adaptation in the mouth,
clinical failure,
regulatory non-compliance,
misinterpretation or use of delivered files.
In any event, the Service Provider’s liability is strictly limited to the amount of the invoiced service, excluding any indirect or intangible damage.
8. Controls
All orders become firm after written validation or payment.
dental3ddesign reserves the right to refuse any order that falls outside the scope of indicative digital design.
9. Rates and payment
Prices are given in euros and include VAT.
No delivery of final files will be made until full payment has been received.
10. Deadlines
Deadlines are given as an indication only.
No delay will give rise to compensation or cancellation.
11. Intellectual property
Files and designs remain the intellectual property of dental3ddesign until full payment has been received.
Unauthorized reproduction or distribution is prohibited.
12. Privacy
The files transmitted are treated as strictly confidential (anonymous) and will not be kept for more than two months.
13. Applicable law
These terms and conditions are governed by French law.
In the event of a dispute, an amicable solution will be sought before any legal action is taken.
