Hereinafter referred to as “the Service Provider”.<\/p>

2. Scope of application<\/h2>

These General Terms and Conditions (GTC) apply to all services offered by dental3ddesign.<\/p>

Services are strictly reserved for professional customers<\/strong> working in the dental field.<\/p>

All orders imply full and unreserved acceptance of these terms and conditions.<\/p>

3. Nature of services<\/h2>

dental3ddesign exclusively provides digital design services<\/strong> for dental files (in particular STL files or equivalent).<\/p>

Delivered files :<\/p>

  • are numerical representations only<\/strong>,<\/p><\/li>

  • are provided for information only<\/strong>,<\/p><\/li>

  • have no medical, clinical or therapeutic purpose<\/strong>.<\/p><\/li><\/ul>

    They do not constitute an opinion, analysis or validation<\/strong>.<\/p>

    4. Total lack of medical advice and competence<\/h2>

    dental3ddesign expressly declares that :<\/p>

    • no healthcare professionals are employed by or associated with the company,<\/p><\/li>

    • no medical, paramedical or clinical skills are claimed,<\/p><\/li>

    • no service constitutes an act of care, diagnosis or treatment.<\/p><\/li><\/ul>

      Files supplied :<\/p>

      • does not constitute advice<\/strong>,<\/p><\/li>

      • cannot be interpreted as a clinical recommendation or validation,<\/p><\/li>

      • are provided for information purposes only<\/strong>.<\/p><\/li><\/ul>

        Any interpretation or use is the sole responsibility of the Customer<\/strong>.<\/p>

        Dental3DDesign exclusively provides digital services.<\/strong>
        No medical devices are physically manufactured, marketed or delivered by Dental3DDesign.<\/strong>
        Manufacturing, regulatory compliance and clinical use are the sole responsibility of the laboratory and the professional responsible.<\/strong><\/p>

        5. Exclusion of all prosthesis manufacture<\/h2>

        dental3ddesign is not a denture manufacturer<\/strong>.<\/p>

        The company is not involved at any time in :<\/p>

        • manufacturing,<\/p><\/li>

        • transformation,<\/p><\/li>

        • marketing,<\/p><\/li>

        • certification,<\/p><\/li>

        • regulatory compliance
          of medical devices and dental prostheses.<\/p><\/li><\/ul>

          The files supplied do not constitute medical devices<\/strong> within the meaning of French or European regulations.<\/p>

          6. Customer’s liability<\/h2>

          The Customer acknowledges and accepts that :<\/p>

          • the files provided are rough, indicative and not clinically validated<\/strong>,<\/p><\/li>

          • it is the user’s responsibility to check, modify, adapt or refuse them<\/strong> before any use,<\/p><\/li>

          • any manufacture or end use is the sole responsibility of the healthcare professional.<\/strong><\/p><\/li><\/ul>

            The Customer remains solely responsible for :<\/p>

            • clinical and functional results,<\/p><\/li>

            • regulatory compliance of the final product,<\/p><\/li>

            • the safety of the manufactured device,<\/p><\/li>

            • the relationship with the end patient.<\/p><\/li><\/ul>

              7. Limitation of liability<\/h2>

              dental3ddesign shall not be held liable in particular in the event of :<\/p>

              • functional or aesthetic defect,<\/p><\/li>

              • non-adaptation in the mouth,<\/p><\/li>

              • clinical failure,<\/p><\/li>

              • regulatory non-compliance,<\/p><\/li>

              • misinterpretation or use of delivered files.<\/p><\/li><\/ul>

                In any event, the Service Provider’s liability is strictly limited to the amount of the invoiced service<\/strong>, excluding any indirect or intangible damage.<\/p>

                8. Controls<\/h2>

                All orders become firm after written validation or payment.<\/p>

                dental3ddesign reserves the right to refuse any order that falls outside the scope of indicative digital design<\/strong>.<\/p>

                9. Rates and payment<\/h2>

                Prices are given in euros and include VAT.<\/p>

                No delivery of final files will be made until full payment has been received.<\/p>

                10. Deadlines<\/h2>

                Deadlines are given as an indication only.
                No delay will give rise to compensation or cancellation.<\/p>

                11. Intellectual property<\/h2>

                Files and designs remain the intellectual property of dental3ddesign until full payment has been received.<\/p>

                Unauthorized reproduction or distribution is prohibited.<\/p>

                12. Privacy<\/h2>

                The files transmitted are treated as strictly confidential (anonymous) and will not be kept for more than two months.<\/p>

                13. Applicable law<\/h2>

                These terms and conditions are governed by French law.
